Emergency Preparedness Contest
Rules & Regulations
The contest begins on September 25, 2019 at 12:00 AM Pacific Standard Time (“PT”) and closes October 17, 2019 at 11:59 PM PT (the “Contest Period”).
The Emergency Preparedness Contest (the “Contest”) is open to all legal residents of British Columbia who are nineteen (19) years or older. Contest is NOT open to employees, agents, officers or directors (and those with whom they are domiciled) of the British Columbia Earthquake Alliance (the “Alliance”), British Columbia Automobile Association (“BCAA”), any of its affiliated CAA National or regional CAA motor clubs (collectively, the "CAA Clubs"), any subsidiary or affiliate of BCAA or a CAA Club, and their respective advertising and promotion agencies (collectively, the “Released Parties”).
HOW TO ENTER:
Entry. No purchase necessary. To be entered into the Contest, each entrant must complete and submit an online or paper entry ballot during the Contest Period including their name, address, email, telephone number and, if applicable, BCAA Membership number. Online entry ballots must be submitted at www.bcaa.com/prepare (the “Contest Website”). Paper ballots must be submitted by depositing into the ballot box of any BCAA Service Location or BCAA Auto Service Centre. By entering the Contest, all entrants agree to be bound by and comply with these Contest Rules. All decisions of BCAA with respect to this Contest are final and binding without any right of appeal. All entries and all Release & Waivers provided to BCAA become the property of BCAA.
Entry Limit.There is a limit of one entry per person. Additional entries received from any individual beyond the first entry received from that individual will be void. Entries generated by automated means or which, in the opinion of BCAA, are intended to subvert the entry process, will be void. All entries must be received by 11:59:59pm, October 17, 2019, the Contest closing date. BCAA (the sponsor) is not responsible for any entries destroyed, mutilated, lost or misdirected. Although online access and an email account can be used in order to participate in this Contest, no purchase of any kind is required. Many public libraries, retail businesses and others offer free access to computers and a number of Internet service providers and other companies offer free email accounts.
There is one (1) prize package available to be won at each BCAA Service Location and Auto Service Centre and five (5) prize packages available to be won online at the Contest Website (bcaa.com/prepare). Each prize consist of:
- 4-person Emergency Preparedness Kit (includes emergency food and water rations and survival supplies); and
- a $75 cash gift card.
The approximate cash value of the prize is $300.00. The prize package must be accepted as awarded, has no cash value, cannot be transferred, substituted or redeemed. All decisions of the judges are final. The winner(s) will be responsible for all applicable taxes associated with the acceptance and use of any awarded prize. No substitutions or cash redemptions of any prize are permitted, except by BCAA which may at its sole to substitute the prizes for a prize of comparable or greater value. BCAA shall not be required to award more prizes than the number of available prizes as set out in these Contest Rules.
HOW TO WIN:
Selection and Notification of Winner(s). A random draw will be held by BCAA personnel in each BCAA Service Location and Auto Service Centre within one week after October 17, 2019 (the “Draw Date”). All eligible entries received by BCAA during the Contest Period will participate in that draw. The draw will be conducted through a random draw of all eligible entries. Odds of winning will depend on the total number of valid entries received during the Contest Period. An entrant whose entry is drawn must correctly answer a skill-testing question in order to be eligible to be awarded a prize. The potential winner will be notified by either e-mail or phone at the telephone number and/or by email provided on the entry. If, for any reason, after three (3) attempts it is not possible within a forty-eight (48) hour period to contact a selected entrant(s), BCAA reserves the right to disqualify that potential entrant(s) and randomly select another entrant(s) for the corresponding prize. If for any reason, any prize is not awarded within three (3) months of the Draw Date, at its discretion, BCAA may decide not to award the prize(s). Except for the selected entrant(s), no other entrants will be notified about the results of the Contest. In order to be declared a winner, the selected entrant must first sign a Release and Waiver (including a Publicity Release), agreeing to the use of his or her name, photo, voice and/or statements without compensation other than the prize offered.
Limitations of Liability and Release. The Released Parties are not responsible or liable for: any incorrect or inaccurate information; technical failures; unauthorized human intervention in the entry process; typographical, printing, mechanical, human or other errors or malfunctions; any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt, use or misuse of any prize; or lost, incomplete, late, misdirected, undelivered, stolen, or mutilated entries. Each entrant releases, indemnifies, and holds harmless the Released Parties from any and all claims, actions, damages, demands, and liabilities of whatever nature or kind arising out of or in connection with the entrant’s: participation or attempted participation in the Contest, compliance or non-compliance with these Contest Rules, and acceptance, use or misuse of the prizes. BCAA reserves the right to substitute another prize of equal or greater value should this prize become unavailable for any reason and to cancel this promotion at any time for any reason whatsoever including, but not limited to, printing or production errors pertaining to the Contest promotional materials, unavailability of the prize due to situations with prize suppliers which are beyond the reasonable control of BCAA or if any virus, bug or other cause beyond the reasonable control of BCAA corrupts the security or proper administration of the Contest. Any attempt to deliberately damage any BCAA website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and, should such an attempt be made, BCAA reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. BCAA reserves the right, in their sole discretion, to modify the Contest rules without materially affecting the terms and conditions of the Contest.
General. The Contest is subject to all federal, provincial and municipal laws and regulations and is void where prohibited by law. Any and all disputes arising out of or connected with this Contest shall be resolved individually and exclusively by the Courts of the Province of British Columbia, and the Contest and these Contest Rules shall be governed by the laws of the Province of British Columbia. At its sole discretion, BCAA reserves the right to modify these Contest Rules and/or cancel, terminate, modify or suspend the Contest without notice.
